Marriage Equality: Our answer to many questions

EK Bumper StickerWe are getting questions about the status of our current marriages, and the likelihood marriage equality will somehow be taken from us by a Trump administration.

It is highly – if not extremely – unlikely our marriages are in danger. The US Supreme Court ruled definitively that marriage equality is the law of the land. For current or future marriages to be invalidated or stopped altogether, whole new lawsuits would have to start at the local level, be successfully appealed (probably more than once), and then taken up once again by the US Supreme Court.

The probability of that happening is vanishingly small. Reversing major rulings such as last year’s Obergefell are among the most rare events in our nation. Reversing the Dred Scott ruling that upheld slavery took a civil war and a series of Constitutional amendments.

The danger to the LGBT community will come now in the form of even more aggressive religious refusal (so-called “religious freedom”) legislation. We must fight these laws and policies with everything we have. We WILL fight these laws with everything we have.

Last night’s election outcomes, while horrific, are nothing more than a speed bump in the long struggle for equal rights and equal treatment for all. That struggle continues.
