Last Friday, August 24, Kansas attorney general Derek Schmidt signed on to an “amicus curiae” brief, asking the United States Supreme Court to overturn a 6th District Court of Appeals ruling upholding regulatory interpretations that include gender identity in workplace non-discrimination laws.
The underlying case concerns a Detroit, Michigan funeral director fired after she informed her employer she was transgender. In a lower court ruling, it was found the 90’s era Religious Freedom Restoration Act exempted R.G. & G.R. Harris Funeral Homes from workplace discrimination laws.
Equality Kansas believes there was no need or justification for the State of Kansas to join this lawsuit. For the past 50 years, the United States has recognized the principle that discrimination damages our nation and demeans its people.
This latest attempt to tear down the wall between church and state – to cite religion as an excuse to legally discriminate against fellow Americans – is just one more dangerous step on the road to divide us, to separate anyone different, and destroy the lives of those with whom we disagree.
Equality Kansas calls on Attorney General Schmidt to withdraw from this lawsuit and instead focus on his job of enforcing the laws of Kansas and providing for the safety and security of all.
